OMC Joins AHA in Lawsuit Aimed at CMS Site-Neutral Rule

AHA-sponsored lawsuit is over outpatient payment policy that threatens patient access to care
 
PORT ANGELES – Olympic Medical Center is a named plaintiff in an American Hospital Association (AHA) and Association of American Medical Colleges (AAMC) sponsored lawsuit filed against the US Department of Health and Human Services (HHS) over a recent Centers for Medicare and Medicaid rule implementing site neutral payment cuts to Medicare. 

"We are pleased to join the American Hospital Association and the Association of American Medical Colleges in a lawsuit against CMS challenging the site neutral rule,” says Jennifer Burkhardt, general counsel and chief human resources officer. "We are challenging the rule – which results in a 30% cut to Medicare reimbursement to offsite hospital-based departments starting in 2019 and by 60% in 2020 – because we believe that CMS exceeded its authority in implementing this rule.”

AHA, AAMC, Olympic Medical and two additional plaintiffs allege in the lawsuit that CMS implemented Medicare cuts contrary to bipartisan legislation Congress enacted in 2015 grandfathering reimbursement for existing off-site hospital-based clinics. Further, the rule is non-budget neutral, meaning the cuts reduce overall Medicare funding for outpatient hospital services, rather than redirecting funds to other sites of outpatient care. 

"Hospital-based off-site clinics are essential to our community, so it is important that we challenge CMS on this issue,” adds Burkhardt.
